The Justice Department’s criminal division is looking into the Boeing 737 Max, a person familiar with the matter said, although the exact parameters of that inquiry could not immediately be learned.

Additionally, an investigator with the U.S. Department of Transportation’s Office of Inspector General has sought information about the Federal Aviation Administration’s certification of the plane and its training materials, according to a source with knowledge of that effort.

It was unclear to what extent the efforts may overlap. But the pursuit of information by federal investigators comes as the FAA and Boeing face growing questions about the way the government and company worked together to certify the airplane involved in crashes in Ethi­o­pia and Indonesia within months of each other.

The FAA has for years relied heavily on Boeing and the other companies it regulates to do much of the work of certifying safety, prompting critics to warn that the agency’s approach to the industry is too lenient and could be dangerous. The FAA has argued that its processes are “well established and have consistently produced safe aircraft designs.”

The FAA and Boeing declined to comment on the work of federal investigators. As with all legal matters, “we do not comment even as to whether such matters exist,” a Boeing spokesman said. The company had said earlier that the FAA’s certification requirements for the 737 Max aircraft were “identical” to those that “governed certification of all previous new airplanes and derivatives.”

The FAA did not say if it was looking at an internal investigation of its own, but a spokesman said that “our full focus is on the software upgrade and supporting the accident investigation.”

The software change is meant to address an automated feature of the Max jets that investigators say contributed to the Oct. 29 crash in Indonesia that killed 189 people. Flawed sensor data feeding into the plane’s anti-stall system helped push the aircraft downward and into the Java Sea, according to a preliminary report.

A spokesman for the Transportation Department’s Office of Inspector General would not confirm or deny an investigation. The office does, however, have an auditing arm. The spokesman said that while no new audit has been announced into the Max certification, the office is always “evaluating our use of audit resources and considering future audit work in light of emerging issues,” including congressional requests and earlier audits it has performed on the FAA’s airplane certification procedures.

The Wall Street Journal, citing unnamed sources, first reported that a grand jury in Washington had issued a subpoena to at least one person involved in the development of the 737 Max. The Journal also said a second inquiry by the Transportation Department’s inspector general is focused on the Seattle-area office of the FAA charged with certifying aircraft as well as an office that mandates training requirements.

Meanwhile, data from the flight recorders on the Ethio­pian Airlines jet show “clear similarities” with the October Lion Air flight in Indonesia, investigators in France said Monday, echoing comments from Ethiopian authorities over the weekend.

“You got two airplanes of the same type that have experienced problems. So of course they are going to go back and look at the certification process. FAA is going to look at that themselves. And it also appears DOT is going to look at it,” said John M. Cox, a former pilot and an airline safety consultant with the Washington-based aviation safety consulting firm Safety Operating Systems. “They are going to look at everything.”

Even as investigators studying the data have found several similarities, Larry Rooney, president of the Coalition of Airline Pilots Associations (CAPA), a trade association for more than 30,000 pilots, said that does necessarily mean a quick resolution.

“I suspect even though there will be some similarities, [the crashes] won’t be mirror images of each other,” Rooney said. “No two accidents are exactly the same.”

And then there is the question of when the planes will fly again. In 2013, when the FAA grounded Boeing’s 787 Dreamliner amid concerns about the plane’s lithium ion batteries, it took three months before the aircraft returned to the skies.

“Grounding [the 737 Max jets] was easy; ungrounding it is going to be hard. The question is going to be how much is going to be enough to put the airplane back in the air,” Rooney said.

Rep. Peter A. DeFazio (D-Ore.), chairman of the House Transportation Committee, said last week that he plans to hold one or more hearings on the Boeing crashes.

On Sunday, Ethiopia Transport Minister Dagmawit Moges said the condition of the data and voice recorders was good and that enough data had been recovered that her ministry’s Accident Investigation Bureau would release a preliminary report in 30 days on what happened to Flight 302.

Officials with France’s Bureau D’Enquetes et D’Analyses (BEA) confirmed the “clear similarities” Monday, in announcing that the data from the flight recorders had been transferred to the Ethiopian Accident Investigation Bureau.

The BEA, which has extensive experience analyzing crashes in Europe, began work March 15 to retrieve information from the flight data recorder. Its role in the investigation is now complete, as it has handed off the retrieved data to Ethi­o­pia for further analysis.

Last week investigators found a device known as a jackscrew in the wreckage, which suggests the Ethio­pian flight might have had a problem with the automated system also suspected in the Lion Air crash.

The jackscrew, used to set the device that raises and lowers the plane’s nose, indicates the jet was configured to dive, Cox said.

That was the second piece of information suggesting similarities between the two crashes involving Boeing 737 Max 8 jets.

FAA officials last week also cited satellite tracking data as a key similarity. The planes in both cases ascended and descended multiple times before crashing, experts said.

Initial flight data as well as subsequent satellite information showed the Ethio­pian Airlines plane in trouble almost immediately and that it had an erratic flight path during the six minutes the plane was in the air before it crashed into a field outside Addis Ababa, killing all 157 aboard.

Officials from the U.S. National Transportation Safety Board (NTSB), which sent three investigators to France, the FAA, and Boeing also are assisting in the probe.

U.S. investigators will continue to assist in the analysis of the data, an NTSB spokesman said Monday. Any progress report on the investigation will be issued by Ethio­pian authorities, per international protocol.

Boeing on Sunday said the company was working with the authorities to evaluate new information as it becomes available.

“Safety is our highest priority as we design, build and support our airplanes. As part of our standard practice following any accident, we examine our aircraft design and operation, and when appropriate, institute product updates to further improve safety,” the company said in a statement.

“While investigators continue to work to establish definitive conclusions, Boeing is finalizing its development of a previously-announced software update and pilot training revision that will address” the way the automated anti-stall feature, known as MCAS, responds to “erroneous sensor inputs. We also continue to provide technical assistance at the request of and under the direction of the National Transportation Safety Board, the U.S. Accredited Representative working with Ethiopian investigators,” the company said.

In all, more than 300 people have died in the two crashes involving the Max 8 jet.

In November, Boeing issued a bulletin on how to reset the stabilizer if it started to push the plane’s nose down.

Boeing said last week it had stopped delivery of all 737 Max jets. The company said it would continue manufacturing them, however.

The recorders from the Boeing 737 Max 8, which crashed March 10 shortly after takeoff from Addis Ababa, have been sent back to Ethiopia, French air accident investigation body BEA told dpa.

The Paris-based body said in a statement that French, Ethiopian and U.S. officials had verified “correct data extraction” from the two boxes — the flight data recorder, or FDR, and cockpit voice recorder.

The BEA — Bureau d'Enquete et d'Analyses (Bureau of Investigation and Analysis) — also confirmed Sunday’s statement from Ethiopian Transport Minister Dagmawit Moges that the data showed similarities with the October crash of a Lion Air Boeing 737 Max 8 plane off the coast of Indonesia that killed 198 people.

“During the verification process of the FDR data, clear similarities were noted by the investigation team between Ethiopian Airlines Flight 302 and Lion Air Flight 610, which will be the subject of further study during the investigation,” the BEA said.

Aviation authorities around the world grounded Boeing 737 Max 8 and Max 9 planes after the Ethiopian crash. The models are the latest version of the U.S. manufacturer's narrow-body workhorse.

Moges said Sunday that “detailed information” based on the black box data would be released within a month.

The developments come amid reports that the U.S. Department of Transportation has begun an inquiry into the certification process for the jet’s systems.

The Transportation Department’s inspector general had begun looking into the plane’s design certification before the Ethiopian Airlines crash, The Wall Street Journal reported.

The inspector general wants to know whether the Federal Aviation Administration took appropriate steps in approving the 737 Max’s anti-stall system, the newspaper said.

The FAA declined to comment on the report, referring questions to Boeing. A spokesman for the company told dpa it does not comment on legal matters, litigation, or governmental inquiries, adding, “we do not comment even as to whether such matters exist.”

An earlier FAA statement said its aircraft certification processes are well established and have consistently produced safe aircraft designs.

“The 737-Max certification program followed the FAA's standard certification process,” the FAA said.

Questions have arisen over whether pilots worldwide were informed about the system and how to react when it was automatically activated. The aircraft system includes software designed to prevent the aircraft stalling on takeoff.

Boeing CEO: 'We know lives depend on the work we do'

The Journal also reported Sunday that a grand jury in Washington issued a subpoena the day after the crash in Ethiopia to at least one engineer involved in the development process of the jets.

A spokesman for the Department of Justice declined dpa’s request for confirmation.

“As a general matter, the department will neither confirm nor deny the existence of any ongoing investigation,” a department spokesman said.

Boeing said Sunday in a statement it is in the process of finalizing the update. The statement also quoted Boeing Chief Executive Dennis Muilenburg as saying the company continues to support the Ethiopian investigation.

“As part of our standard practice following any accident, we examine our aircraft design and operation, and when appropriate, institute product updates to further improve safety,” Muilenburg said.

Ethiopian Airlines black boxes show similarities to Lion Air crash: ministry | killexams.com real questions and Pass4sure dumps

ADDIS ABABA/WASHINGTON (Reuters) - The crash of an Ethiopian Airlines plane that killed 157 people had “clear similarities” with October’s Lion Air crash, Ethiopia said on Sunday, shown by initial analysis of the black boxes recovered from the wreckage of the March 10 disaster.

The crash has generated one of the most widely watched and high-stakes inquiries for years, with the latest version of Boeing’s profitable 737 workhorse depending on the outcome.

Both planes were MAX 8s, and both crashed minutes post take-off after pilots reported flight control problems. Concern over the plane’s safety led aviation authorities to ground the model, wiping billions of dollars off Boeing’s market value.

“It was the same case with the Indonesian (Lion Air) one. There were clear similarities between the two crashes so far,” Ethiopian transport ministry spokesman Muse Yiheyis said.

“The data was successfully recovered. Both the American team and our (Ethiopian) team validated it,” he told Reuters, adding that the ministry would provide more information after three or four days.

In Washington, however, U.S. officials told Reuters the FAA and U.S. National Transportation Safety Board (NTSB) had not yet validated the data.

Boeing’s safety analysis of a new flight control system known as MCAS on MAX jets had several crucial flaws, one of which was that it understated the power of the system, the Seattle Times said on Sunday.

The FAA also did not delve in detailed inquiries and followed a standard certification process on the MAX, the paper said, citing an FAA spokesman.

The FAA declined to comment on the report but referred to previous statements about the certification process. It has said the process followed FAA’s standard process.

Citing people familiar with the inquiry, the Wall Street Journal said Department of Transportation officials are scrutinizing the FAA’s approval of MAX jets and a Washington, D.C. grand jury issued a subpoena to at least one person involved in the MAX’s development.

The subpoena dated March 11 - a day after the Ethiopian Airlines crash - listed as a contact a prosecutor from the Justice Department’s (DoJ) criminal division and sought documents to be handed over later this month, the paper said.

It was not immediately clear whether the DoJ subpoena was related to the DoT’s inquiry, which focuses on MCAS, implicated in the Lion Air crash that killed 189 people, the WSJ added.

Boeing and the FAA declined to comment on the WSJ report.

Two government officials briefed on the matter told Reuters it would not be surprising for the Transportation Department to investigate a major safety issue, but could not immediately confirm the report.

SAFETY ANALYSIS

An official told Reuters that when investigators - after reviewing black box data from the Ethiopian Airlines crash - return to Addis Ababa to conduct interpretive work, the NTSB and FAA will assist in verification and validation of the data.

A second source said little information had been circulated between parties about the contents of data and voice recordings.

It was not clear how many of the roughly 1,800 parameters of flight data and two hours of cockpit recordings, spanning the doomed six-minute flight and earlier trips, had been taken into account in the preliminary Ethiopian analysis.

International rules require a preliminary report on the crash to be released within 30 days.

Previous air crash reports show that in such high-profile cases there can be disagreements among parties about the cause.

In Paris, France’s BEA air accident investigation agency said data from the jet’s cockpit voice recorder had been successfully downloaded. The French agency said on Twitter it had not listened to the audio files and the data had been transferred to Ethiopian investigators.

In Addis Ababa, a source who has listened to the air traffic control recording of the plane’s communications said flight 302 had an unusually high speed after take-off before it reported problems and asked permission to climb quickly.

Last Monday, Boeing, shares of which have fallen 10 percent in the week since the crash, said it would deploy a software upgrade to the 737 MAX 8, hours after the FAA said it would mandate “design changes” in the aircraft by April.

Boeing was finalizing the software change and a training revision and would evaluate new information as it became available, Chief Executive Dennis Muilenburg said in a statement on Sunday, after the Ethiopian transport ministry’s comments.

A Boeing spokesman said the 737 MAX was certified in line with identical FAA requirements and processes that governed certification of all previous new airplanes and derivatives. The spokesman said the FAA concluded that MCAS on 737 MAX met all certification and regulatory requirements.
